If you are not present at the delivery address at the time of delivery, our driver may follow our standard protocol, which may include leaving the order at the door or returning the order, depending on the circumstances.

EXCEPT AS PROVIDED IN SECTION 15.4 BELOW, ALL DISPUTES, CONTROVERSIES, OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL BE RESOLVED BY BINDING ARBITRATION RATHER THAN IN COURT. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration organization. By agreeing to arbitration, you and Pizza Inn each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or any other representative proceeding.

15.3 Class Action Waiver

YOU AND PIZZA INN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Inn agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15.4 Exceptions to Arbitration

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened misappropriation or infringement of intellectual property rights or to address issues involving the safety or security of individuals or the general public. Claims that qualify for small claims court may also be brought in that forum.

16. Term and Termination
